What Is Workers’ Compensation in Pennsylvania? 

Workers’ compensation is a state law provided under the PA Workers’ Compensation Act that requires employers to purchase insurance coverage to provide workplace compensation benefits to employees who become sick or injured on the job.  Employers pay for this insurance and it does not require the employee to pay toward the cost of compensation. Through the workers’ compensation coverage, workers are provided benefits such as lost wages and medical care if they become sick or injured on the job.  As a result of this law, employers are protected from personal injury lawsuits by injured workers.

Moreover, an employer must be on notice of the injury, and the employee must give notice to the employer within 120 days of the injury and no compensation is due until notice is given.  

If a request for worker’s compensation benefits is denied by the employer or the employer's insurance carrier, the employee will have three years from the date of injury to file a Claim Petition. Once an employee reports a work injury, the employer is required to report the injury to the Bureau of Workers' Compensation by filing a first report of injury and also report it to their workers’ compensation carrier.
